REFUND & CANCELLATION POLICY

At ABOME Real Estate Private Limited (“ABOME”, “we”, “our”, or “us”), we are committed to maintaining transparency throughout the purchase process. This Refund & Cancellation Policy outlines the terms governing cancellation requests and refunds relating to the purchase of plots in the YOG ANAND project.

By submitting an application, booking a plot, or executing any transaction relating to the Project, you agree to the terms set forth below.

1. Applicability

This Policy applies to:

  • Expressions of interest
  • Plot registrations
  • Booking amounts
  • Provisional allotments
  • Plot allotments
  • Agreement for Sale transactions

This Policy shall be read together with:

  • Application Form
  • Provisional Allotment Letter
  • Agreement for Sale
  • MahaRERA provisions
  • Applicable laws and regulations

In the event of any inconsistency, the terms of the registered Agreement for Sale and applicable laws shall prevail.

2. Cancellation Before Allotment

An applicant may withdraw their application before issuance of a Provisional Allotment Letter by submitting a written cancellation request.

Subject to verification and adjustment of any applicable charges, the eligible amount shall be refunded within a reasonable period in accordance with applicable laws and company policies.

3. Cancellation After Provisional Allotment

After issuance of the Provisional Allotment Letter, cancellation requests must be submitted in writing to the Company.

Refunds, if applicable, shall be processed after adjustment of permissible deductions, including but not limited to:

  • Earnest money
  • Administrative expenses
  • Taxes already deposited with government authorities
  • Brokerage paid to channel partners, if applicable
  • Documentation charges
  • Any statutory charges already incurred

The balance amount, if any, shall be refunded in accordance with the terms agreed between the parties and applicable laws.

4. Cancellation After Execution of Agreement for Sale

Where an Agreement for Sale has been executed and registered, cancellation shall be governed strictly by:

  • The terms of the registered Agreement for Sale
  • Applicable MahaRERA provisions
  • Applicable statutory regulations

Additional deductions may apply, including:

  • Stamp duty and registration charges
  • Charges relating to cancellation deeds
  • Taxes already paid to authorities
  • Any other statutory obligations

5. Promoter-Initiated Cancellation

ABOME reserves the right to cancel an allotment in circumstances including, but not limited to:

  • Persistent payment defaults
  • Dishonour of payment instruments
  • Submission of false, misleading, or incomplete information
  • Failure to execute documentation within prescribed timelines
  • Non-compliance with contractual obligations
  • Violation of applicable laws or project policies

Any refund arising from such cancellation shall be processed after adjustment of legally permissible deductions.

6. Refund Timelines

Eligible refunds shall ordinarily be processed within 30 (thirty) business days from the date of approval of the cancellation request, subject to:

  • Completion of all formalities
  • Submission of supporting documents
  • Clearance of outstanding dues
  • Internal verification processes

Refund timelines may vary where statutory approvals or third-party clearances are required.

7. Mode of Refund

Refunds shall be processed only through banking channels and shall be credited to the original bank account of the applicant or to such account as may be permitted after due verification.

No cash refunds shall be entertained.

8. No Interest on Refunds

Refund amounts shall ordinarily be processed without interest unless otherwise required under:

  • The Real Estate (Regulation and Development) Act, 2016
  • MahaRERA regulations
  • Orders of a competent authority
  • The Agreement for Sale

9. Force Majeure

ABOME shall not be liable for delays in processing refunds arising due to circumstances beyond its reasonable control, including but not limited to:

  • Natural disasters
  • Floods, cyclones, earthquakes, or extreme weather events
  • Government restrictions
  • Judicial orders
  • Regulatory directives
  • Pandemic situations
  • Banking disruptions
  • Any other force majeure event

10. Documentation Requirements

Applicants requesting cancellation may be required to submit:

  • Written cancellation request
  • Identity proof
  • Booking receipt(s)
  • Payment proof(s)
  • Original allotment documents, if applicable
  • Bank account details for refund processing
  • Any additional documents as may be required

11. Governing Law

This Policy shall be governed by:

  • The Real Estate (Regulation and Development) Act, 2016
  • MahaRERA Rules and Regulations
  • Applicable laws of India
  • Applicable laws of the State of Maharashtra

12. Jurisdiction

Any dispute arising under this Policy shall be subject to the jurisdiction of MahaRERA and the competent courts and authorities situated in Sindhudurg, Maharashtra.

13. Right to Amend

ABOME Real Estate Private Limited reserves the right to modify, update, amend, or replace this Refund & Cancellation Policy at any time without prior notice, subject to applicable laws.

Updated versions shall become effective immediately upon publication on this website.
